NLRB Judge Orders Hispanics United to Rehire 5 Workers Fired after They Criticized Employer on Facebook

September 6, 2011; Source: WGRZ-TV | On September 2, an administrative law judge at the National Labor Relations Board ordered that Hispanics United must rehire five workers fired for sounding off about their employer on Facebook. NPQ reported about this case in an article, “Facebook Firings and the Labor Relations Board: What Nonprofits Need to Know,” by Aaron Lester on June 15. Judge Amchan found that the Facebook discussion between the five workers was protected under section 7 of the National Labor Relations Act. This is the first ruling of its kind, providing some guidance to the growing number of cases filed with the NLRB of late.—Ruth McCambridge
